A driver pulled over by a police car at night

A DUI is a life-changing conviction. Even first-time DUI offenders may be subject to serious consequences, including community service, fines, points on your driving record, and jail time. The severity of these consequences only increases if your bodily alcohol content (BAC) is higher than .17% or if this is not your first DUI offense. Regardless, a DUI conviction will stay on your record for life – that is, unless you are eligible for expungement under the new laws.

In August 2021, laws were passed in Michigan that allows drivers to have a DUI expunged. Governor Gretchen Whitmer signed House Bills 4219 and 4220, stating “No one should be defined by a mistake they have made in the past.” The measures outlined by these new laws go into effect in February 2022, so now is the perfect time to start the expungement process.

Am I Eligible to Have My DUI Expunged in Michigan?

There are several limitations to the new expungement law. For example, it’s important to note that DUI convictions will never be eligible for automatic expungement. If you want to remove your DUI from your record, you are required to apply to expunge it.

You may be eligible to apply for DUI expungement in Michigan if:

  • You have only one DUI conviction
  • At least five years have passed since your DUI conviction
  • Your DUI did not cause serious injury or death
  • Your DUI did not occur when driving a commercial vehicle with a commercial driver’s license (CDL)
